Back to The Future: ACA Edition
I don’t know about you, but it sure feels like it’s 2012 all over again to me. Why? After all the talk and all the votes, we’re finally going to find out how healthcare reform is going to operate in the U.S. Déjà vu?
After his inauguration on January 20, Donald Trump will officially be the next president of the United States. As you’ve no doubt heard or read, Congress and President-elect Trump have vowed to repeal and replace the Affordable Care Act (ACA) as soon as the new administration takes office.
In 2012, we were waiting for the Supreme Court decision on the constitutionality of the individual mandate. Once that decision was made, the government was able to iron out the ACA’s details. Now, we’re wondering how Congress can navigate the unwinding of the ACA, implement a new plan and simultaneously keep everyone who gained coverage under the ACA covered during the transition. That’s going to be a big job. And just like in 2012, we’re going to embark on a journey filled with a massive amount of discussion, trial balloons, statutes, regulations and news coverage.
This time around, it’s going to be even more than before. In addition to putting a new plan in place, the ACA also has to be unwound. That alone is a major undertaking, and the talk on how that’s going to happen is already in overdrive. My advice to you now is the same as it was back then – don’t always listen to the chatter.
“I’m going to repeal the ACA on day one” has become “we’re looking at how to do this without jeopardizing anyone’s coverage.” Campaign promises of eliminating every piece of the ACA have evolved to keeping parts of the ACA that work relatively well. Stay focused on what actually happens in Congress – not what they talk about. Federal agencies will also begin changing existing regulations according to guidance from the White House. All we know right for now is we’ll see major changes in the employer healthcare space.
